Rental agreement
Rental conditions
1. Agreement
This agreement is binding on the renter and those who represent him. The renter does not have the right to transfer this contract in whole or in part to third parties. The person who signs the contract is always responsible for the vehicle and everything stated in this agreement. Taking the vehicle into use implies the acceptance – without reservation – of our full rental conditions. This agreement also applies in the event of the free provision of a motorhome.
2. Departure guarantee
If – for whatever reason – the reserved vehicle is not available, the renter has the right to demand a replacement vehicle, just as the lessor has the right to provide another vehicle, of course on condition that it is comparable.
3. Driving license and identity card
The renter must present a photocopy of the driver's license and identity card or passport.
4. Age
The minimum age for driving the vehicle is 23 years.
5. Price calculation – reservation
The reservation is only final after receipt of 50% of the rental amount. The balance must be paid no later than 30 days before the start of the rental period. Failing this, the lessor has the right to re-let the reserved period without this giving any right to a refund of the paid deposit to the tenant. The lessor reserves the right to correct any addition errors in order to make the rental agreement correct.
6. Warranty
The tenant owes the landlord a deposit. The deposit is € 1000.- to be paid in cash. The deposit will be returned to the tenant upon return. In the event of damage, the landlord has the right to retain the deposit to offset the damage. The following may be deducted from the deposit:
Fines, missing parts, damage inside and outside (including cigarette burns, blown tires, scratches from branches, etc.), damage caused by third parties, theft of parts, damage due to burglary, uncleaned car, etc.
The check on receipt of the vehicle in good condition is always subject to any hidden damage and/or defects subsequently discovered.
7. The rental price includes
- The BTW in this regard
- Third Party Liability Insurance (B.A.)
- The comprehensive insurance with a deductible of € 1,000 per claim.
- “Go Safe”: breakdown and repatriation costs of vehicle and insured – criminal surety – legal costs. All this according to the conditions of “De Europese”.
- Legal expenses insurance
- The necessary repairs to the engine and mechanics while on the road, upon presentation of a clear and official invoice in the name of Alpha Motorhomes NV – Kapelanielaan 13 A – 9140 Temse (VAT BE 0443.542.792)
Please note: regular receipts are not accepted! Maintenance and repairs must be carried out by an approved brand garage. For repairs of €125 or more, the tenant is obliged to contact the landlord in advance, otherwise the landlord reserves the right to refuse a refund.
8. The rental price does not include
- The costs of repairs to the engine and mechanical parts resulting from improper use or neglect of required maintenance, etc.
- The costs of damage resulting from improper use, intent, carelessness, improper use (driving on unpaved roads, through riverbeds, seawater, etc.)
- Fuel
- The insurance of the tenant's personal belongings, unless additional insurance has been taken out.
- The “occupants” insurance unless additional insurance has been taken out.
9. Cancellation and cancellation insurance
Cancellation does not automatically entitle you to terminate this contract, nor to a refund of the deposit. If the reservation is made more than 30 days before departure, cancellation insurance is mandatory and the conditions stated in the policy apply.
10. Rental period
In principle, the rental period starts on Friday afternoon when departing on Friday and ends on Friday morning at 10:00 am. When departing on Saturday, the rental period starts on Saturday afternoon and ends on Saturday morning at 10:00 am.
If a vehicle cannot leave on the agreed day due to a technical defect, but only the next day, the rental agreement remains valid. In this case, the renter cannot claim any compensation or damages.
In deviation from what is stated under rental period, tenant and landlord can agree on a different period. This only after written agreement.
11. Use of the vehicle
- The renter may only use the vehicle if all legal provisions are strictly observed.
- It is prohibited to use the vehicle for pushing or towing, to sublet it, to use it for paid passenger or goods transport, to use it for races, speed tests or competitions.
- It is prohibited to attach stickers to the vehicle.
- The renter is obliged to check tire pressure, coolant, etc. daily.
- The renter must ensure that in the event of a flat tire, the damaged tire is repaired.
- Dogs and pets in general are not allowed in the vehicle.
- The use of frying oil or highly flammable substances in the vehicle is prohibited.
- The use of a luggage or bicycle carrier is entirely at the renter's risk, as is any damage resulting from this.
- It is prohibited to make any adjustments or modifications to the vehicle.
12. Insurance
Under penalty of forfeiture of the insurance guarantees, the countries to be visited must be specified.
If ownership of the vehicle is claimed for reasons of evasion of import duties, excise duty, VAT or for reasons of smuggling, possession of weapons, trafficking in or possession of narcotics or for any other reason, all insurance conditions will lapse and the renter will be legally solely and fully responsible for compensating the lessor for the loss of the vehicle and for all resulting damage and expenses.
Reservations should also be made for areas or places with high risks: such as political unrest, demonstrations, strikes, war, areas at risk of natural disasters, etc.
Excluded from insurance are:
- Damage during transport of the vehicle, loading or unloading.
- Damage caused by poor maintenance, overloading, carelessness, negligence or as a result of driving on impassable roads.
- Damage caused by the tenant, not being the result of a collision.
Countries for which the “green card” does not provide cover may explicitly NOT be visited. Any acknowledgement of responsibility, any agreement, any assessment of damage, any promise of compensation and any payment by the person involved in an accident made without the consent of the insurance company, releases the latter from any obligation towards the insured renter. Each motorhome is insured for as many people as there are approved places.
13. Accidents – damage – violations
The tenant undertakes to notify ALPHA MOTORHOMES immediately in the event of any accident and to confirm this in writing with a complete accident report.
The tenant and the authorized driver are liable for proceedings and violations committed; in no event can the landlord be held liable.
Unauthorised retention of the rented vehicle after the rental period has expired is strictly prohibited and will give rise to legal action, without prejudice to any compensation for damages.
The user or renter releases ALPHA MOTORHOMES from any liability and compensation in the event of a technical defect and for all adverse consequences, permanent physical injuries, etc. that could result from any defect and/or accident, whatever the cause of the accident or damage.
ALPHA MOTORHOMES is not responsible for damage or breakdown due to weather conditions or frost. Any compensation by the lessor is excluded. On the contrary, compensation can be claimed from the tenant who is obliged to take the necessary precautions against weather conditions or against freezing of water installations, boiler, diesel, oil, etc.
14. Pick up and return
The renter must always return the rented vehicle to the place of collection, namely at Alpha Motorhomes – Kapelanielaan 13 A – 9140 Temse, on the day and time agreed in writing. Early return of the vehicle does not give rise to a refund of the rent, not even partially. If the renter fails to return the rented vehicle at the agreed time and place, he will be charged a fee of €50 per hour. This fee can be deducted from the deposit.
15. Force Majeure

If the rented vehicle cannot be made available to the renter due to force majeure (for example an accident), a corresponding part of the rental price will be refunded for each day lost. In any case, the lessor will take the necessary measures to make another equivalent vehicle available. If this happens within 24 hours, the renter cannot claim refusal, request for refund or any compensation or reduction.
A maximum of the full rental amount can not be refunded. The tenant expressly agrees that the landlord can never be held liable for any costs whatsoever.
Subject to express reservation of interim changes and additions, which always form part of this rental agreement.
In the event of a dispute, only the court in the district where the head office of Alpha Motorhomes NV is located has jurisdiction.
